Terms of Service
Last updated: October 24, 2023. By accessing or using the Vexel platform, you agree to be bound by these terms. If you do not agree, please do not use our services.
Who can use Vexel?
To use the Vexel platform, you must be at least 18 years of age and possess a valid physical address within the United States. You represent and warrant that you are legally authorized to enter into these terms.
You must also provide accurate, current, and complete information when creating an account. Vexel reserves the right to suspend or terminate your account if this information is found to be inaccurate or false.
US Based
Services are currently available to homeowners in the United States. International bookings are not supported at this time.
Your obligations as a customer
As a user of the Vexel platform, you agree to:
- Provide Accurate Booking Information: Ensure the address, property details, and service requirements you provide are accurate to avoid service delays or cancellations.
- Safe Access: Ensure the professional has safe and legal access to your property. If you have pets, you must notify the professional in advance.
- Timely Cancellation: If you need to reschedule or cancel, please do so at least 24 hours in advance. Cancellations made within 24 hours may incur a cancellation fee equal to 50% of the estimated service cost.
- Be Present: Unless otherwise arranged, you or a designated representative must be present during the service to answer questions and verify completion.
Property Access
You grant Vexel professionals a limited, non-exclusive license to enter your property solely for the purpose of performing the booked service.
Standards for Vexel Professionals
All professionals operating on the Vexel platform are independently contracted. They agree to:
- Licensing & Insurance: Maintain valid, active licenses and insurance coverage for their specific trade. Vexel reserves the right to verify credentials at any time.
- Conduct Standards: Behave professionally at all times. Professionals are prohibited from smoking, consuming alcohol, or using illegal substances while on a client's property.
- Quality of Work: Perform services to a standard that meets or exceeds industry expectations and the specific description provided in the booking.
- Tool & Equipment: Bring all necessary tools, equipment, and materials required to complete the job. Vexel is not liable for shortages caused by a professional's failure to prepare adequately.
Liability & Insurance
Professionals are responsible for their own actions and liabilities. Vexel is not liable for any injuries, damages, or losses incurred during service execution.
How billing and refunds work
Charges: Charges for services are processed at the start of the scheduled service (or immediately upon booking for prepaid estimates) using the payment method on file. Taxes are calculated based on the service location.
Refund Conditions: Vexel offers a Satisfaction Guarantee. If a professional fails to show up for a scheduled service, or if the service provided is incomplete and not rectified within 48 hours, you are eligible for a full refund.
In the event of a dispute regarding quality or billing, the customer's primary recourse is contacting Vexel Support. If a resolution cannot be reached, the customer may initiate a chargeback with their issuing bank, provided the dispute is made within 90 days of the transaction.
Secure Payments
We use industry-standard encryption to protect your financial data. Vexel does not store your full credit card numbers.
Ownership and Limitation of Liability
Intellectual Property Notice: Vexel, its logo, and all related platform features, code, and content are the exclusive property of Vexel Inc. Unless explicitly stated, you are granted no license to use these assets. User-generated content (photos, reviews) is licensed to Vexel for use in marketing and platform operations.
Limitation of Liability: In no event shall Vexel, its officers, directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
Exclusions
Vexel is an intermediary connecting users with professionals and is not responsible for the quality of workmanship or the independent acts of professionals.
Governing Law and Contact
Governing Law: These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in San Francisco County, California.
Arbitration: You and Vexel hereby agree to submit to the personal and exclusive jurisdiction of the courts located within San Francisco County, California for the resolution of any disputes or claims arising out of or relating to these Terms or the breach thereof.
